EMERGENCY PROCUREMENT FOR
TEMPORARY PUMPING FOR INDIAN HILLS LIFT STATION
The City has determined that the following emergency exists. Due to failure of the the lift station, wastewater from Indian Hills Subdivision to the east of Gallup up to Red Rock Park, cannot be pumped into the wastewater collections line located on the north side of NM118 (Hwy 66). This failure initially led to a discharge of raw wastewater into the street onto Aztec Avenue. This discharge presented an immediate danger to public health and welfare. In order to stop the discharge of raw sewer into the environment and more specifically direct contact with the public such as sewer backups into resident dwellings, the City contracted Dallago Corporation to install a series of pipes from manholes upstream to the lift station into pumps they leased to keep raw wastewater from discharging into the environment and restore movement from the east side of the City's wastewater collection system to the Wastewater Treatment Plant. In addition, the City could be fined $42,000 per day by the Environment Protection Agency (EPA) for potential violations of the Clean Water Act. The existence of the emergency condition creates and immediate and serious need for services, construction or items of tangible personal property that cannot be met through normal procurement methods and the lack of which would seriously threaten:
1) the functioning of the government
2) the preservation or protection of property; or
3) the health or safety of any person
